The recent order from High Court in the UK has stated that R4 carts, employed by Nintendo DS owners to run homebrew and pirated games doesn't abide by law and needs to be stopped for the usage.
The court termed this task to be "game copiers" and stated that these are illegal to be imported, sold or even advertised in UK markets.
Two oppositions, Playables Limited and Wai Dat Chan reported that the devices offer nothing but the mode to run a homebrew option to feature playback movies and music.
The Justice did not oblige with the same and said that the fact that the device can be used for a non-infringing purpose cannot be called as defensive statement.
However Nintendo is arguably not in its best of moods with the decision and stated: We are "pleased that the court was not persuaded by the defendant's arguments, claiming that game copiers are lawful, as they allow for the play of 'homebrew' applications. The court affirmed that game copiers first circumvent Nintendo's security systems before any non-infringing application can be played on Nintendo's handheld products."
