McDonald's and a Malaysian restaurant called McCurry, fighting legal battle for the last eight years over copyright issue, have now reached the Supreme Court of Malaysia after McDonald's decision to challenge the ruling of the lower court.
Earlier, the local court, deciding on the trademark issue on April 29, had denied any infringement of trademark by the local restaurant having one outlet in the capital Kuala Lumpur. McCurry is famous for its "Malaysian Chicken Curry" and other staples and the name drew the wrath of McDonald's.
McCurry owner, P. Suppiah said: "The whole issue is about the name of my restaurant on the signboard."
The court will further take up the matter on Monday, and it would be decided whether the case should be headed for another trial or not.
Malaysia's prominent businessman Vincent Tan owns the operations of McDonald's in the country which has 185 McD outlets.
McDonald's Asia corporate relations vice president, Liam Jeory, added: "McDonald's vigorously defends its trademarks against violations anywhere in the world. This particular case is no different."
